These Terms of Service (“Terms”) govern your use of the Arkeovis mobile application and related services (the “Service”), operated by an independent developer trading as Arkeovis (“we”, “us”, “our”). By using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. Description of service

Arkeovis is an all-in-one mobile application designed for resellers to streamline sourcing, organize inventory, and monitor profits.

2. Eligibility

You must be at least 16 years old (or the minimum age required in your country) to use the Service. If you are under 18, you may only use the Service with parental or legal guardian consent.

3. Account Registration

You are responsible for your account and any activity under it.

You agree not to:

  • share your account with others

  • provide false information

  • attempt to access other users’ accounts

We may suspend or delete accounts that violate these Terms.

4. Subscriptions, Trials, and Payments

Some features require a paid subscription. A free trial may be offered.

Payments are processed by Apple App Store or Google Play. We do not process or store payment details.

Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.

You can cancel anytime via your App Store or Google Play settings. Deleting the app does not cancel the subscription.

Refunds are handled only by Apple or Google, according to their policies.

5. Acceptable Use

You agree to use the Service only for personal or small-scale resale purposes.

You must not:

  • use bots, scraping, or automation

  • attempt to bypass usage limits

  • misuse or overload the Service

  • upload illegal, harmful, or infringing content

  • upload sensitive personal data or identity documents

  • reverse engineer or copy the Service

  • resell or redistribute the Service or its outputs

We may limit or suspend access if usage is abusive or impacts system stability.

6. AI-Generated Outputs Disclaimer

The Service uses AI to generate item identification, price estimates, and resale suggestions.

These outputs are:

  • approximate and informational only

  • not financial, legal, or professional advice

  • not guarantees of value, authenticity, or demand

You are solely responsible for any decisions made based on the Service, and acknowledge that AI-generated outputs are inherently uncertain and you assume full responsibility for decisions based on them.

The Service does not create any professional, advisory, or fiduciary relationship between you and the developer.

7. User Content

You retain ownership of the content you upload.

By using the Service, you grant us a limited right to process your content solely to operate and improve the Service.

We do not:

  • sell your content

  • use it for advertising

  • use it to train general AI models

You are responsible for ensuring you have the rights to upload any content.

8. Third-Party Services

The Service relies on third-party providers such as:
Supabase, RevenueCat, PostHog, Apple, Google, eBay API, AI providers, and email services.

We are not responsible for the availability or actions of third-party services.

9. Availability

The Service is provided on an “as is” and “as available” basis.

We do not guarantee uninterrupted or error-free operation. Features may change or be discontinued at any time.

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to infrastructure outages, third-party service failures, hosting provider downtime, or internet disruptions.

10. Disclaimer

To the maximum extent permitted by law:

  • we make no warranties about accuracy or reliability of the Service

  • AI outputs may be incorrect or incomplete

  • results may vary and should not be relied upon as guarantees

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • financial or commercial losses

  • loss of profits or opportunities

  • incorrect AI outputs

  • service interruptions or data loss

  • third-party service failures

Our total liability is limited to the amount you paid in the last 12 months or €100, whichever is greater.

Nothing in these Terms excludes liability where prohibited by law (including fraud or gross negligence).

12. Termination

We may suspend or terminate access at any time if you:

  • violate these Terms

  • misuse the Service

  • attempt to harm the Service or other users

You may stop using the Service at any time by deleting your account.

13. Intellectual Property

All rights in the Service (excluding user content) belong to Arkeovis.

You may not copy, modify, distribute, or resell any part of the Service.

14. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which forms an integral part of these Terms.

We process personal data only to provide and improve the Service, in accordance with applicable data protection laws.

You may request deletion of your data at any time, subject to legal retention obligations.

15. Governing Law

These Terms are governed by French law.

Any disputes will be handled by the competent courts of France.

EU consumers may also use the EU Online Dispute Resolution platform.

16. Changes

We may update these Terms. If changes are material, we will notify you in the app or by email.

Continued use of the Service means acceptance of the updated Terms.

17. Apple and Google Store Terms

If you access or download the Service via the Apple App Store or Google Play Store, you acknowledge and agree that:

  • These Terms are concluded between you and the developer only, and not with Apple Inc. or Google LLC.

  • Apple and Google are not responsible for the Service, its content, maintenance, or support.

  • Any claims relating to the Service (including product liability, legal compliance, or intellectual property issues) are the responsibility of the developer and not Apple or Google.

  • Billing, payments, subscriptions, cancellations, and refunds are handled exclusively by Apple App Store or Google Play Store, in accordance with their respective terms and policies.

  • Apple is a third-party beneficiary of these Terms where required and may enforce these Terms against you as such.
